ADVERTISING AND PROMOTION

ADMINISTRATIVE REGULATION - 1325

Commercial Advertising
Paid advertisements can be accepted for inclusion in publications that are optionally purchased by students or parents, and/or are primarily intended for a special interest parent audience. Such publications include yearbooks, student newspapers, athletic or performing arts programs, GATE or Special Education Newsletters, etc. The paid advertisements may include commercial brand names, product or company logos.

Advertising from radio, television, posters, or wall-mounted banners shall not be allowed in any instructional space, or other space or facility occupied primarily by students. With the approval of the Superintendent or designee, exceptions can be made for spaces or facilities occupied exclusively by members of an athletic team.

Because a number of educational websites include commercial advertisements, and staff cannot access these websites without exposure to commercial advertisements, we will allow certain advertisements to be viewed by staff members and, in some instances students, so that the information from vetted websites can be utilized for instructional purposes.

Commercial Sponsorship
Statements of commercial sponsorship may be included in publications or communication vehicles intended for a general student or parent audience. Such communication vehicles include school or district newsletters, district or school web pages, etc. Statements of commercial sponsorship shall be limited in size and placement by school authorities. Such statements shall not include any representation designed to promote the purchase of a product or service. Such statements may include a single point of contact such as a phone number or web address. Such statements shall not exceed 1/16 of a typical printed page, nor the equivalent of 100 x 500 pixels on a web page.

Products and materials donated or funded by commercial enterprises may be used in the classroom or distributed as long as they serve an educational purpose and do not unduly promote any commercial activity or the purchase of any product or service. The school may approve product rewards for students who meet educational goals.

Prohibitions
Instructional materials shall not contain "...unnecessary and inappropriate exposure to commercial brand names, products or company logos." (AB116) Materials shall not be distributed to students, nor shall advertisements or statements of commercial sponsorship be permitted in school or district communication vehicles if they:

  1. Are obscene, libelous, or slanderous; (Education Code 48907)

  2. Incite students to commit unlawful acts, violate school rules, or disrupt the school's orderly operation; (Education Code 48907)

  3. Discriminate against, attack or denigrate any group on account of gender, race, color, religion, ancestry, national origin, disability, or other unlawful consideration; or promote one group over another;

  4. Solicit funds or services for an organization, with the exception of solicitations authorized by the Board of Education;

  5. Promote the use or sale of materials or services which are illegal or inconsistent with school objectives;

  6. Promote any particular religious or political interest;

  7. Relate to pregnancy or family planning issues;

  8. Are not easily accessible to parents;

  9. Promote tobacco, intoxicants, firearms, controlled substances, media with age-specific limitations (e.g., R, NC-17, or X movies; 'parental advisory' music or television programming; or multimedia games with industry-defined age guidelines);

  10. Violate any district policy.
