REPLACING OR REPAIRING EMPLOYEES’ PROPERTY

BOARD POLICY - 3544.2

The District may reimburse employees, up to $100, for any damage or destruction of personal property of the employee while on duty in the school, on the school premises, or on a school-sponsored activity.

For the intent of this rule, “personal property’ is defined as eyeglasses and hearing aids.

In the event employees are reimbursed pursuant to this rule, the District shall, to the extent of such payments, be subrogated to any right of the employee to recover compensation for such damage or destruction of personal property. The District may file and prosecute an action to enforce this subrogation right.

An employee filing a claim pursuant to this rule shall file said claim with the principal no later than one (1) working day following the damage or loss of the property in question. The District retains the right to inspect all damaged property and to require full disclosure of witnesses, prior conditions, and full description of damaged or destroyed property. Total District funds allocated for this purpose shall not exceed $2,000 annually (fiscal year). Claims will be submitted to the Board of Education for approval of payment. Claims submitted after the District total allocation is exhausted will not be reimbursed.

In the event of a fire loss, employees’ personal items directly related to teaching activities may be fully reimbursed from the school’s self-insurance fund up to a limit of $600 per occurrence.

(Education Code Section 25213 states that Board of Education may adopt rules and regulations to provide for the payment of the cost of replacing or repairing property of an employee, such as eyeglasses, hearing aids, dentures, etc., damaged in the line of duty.)
